A short sale transaction can already be a complicated one, but if both spouses are on the loan and going through a divorce, they both have to consent to the sale of the property. If their divorce isn’t closed at the time of the sale, some circumstances might change, but as long as both names are on the mortgage they are both financially responsible for that home. If the divorce is finalized at the time of the short sale, they both still have to sign off on the short sale as well.
